Privacy statement

This statement covers the data we process when you visit this website or contact us. It does not cover the Noctua platform itself: there your own organisation is the controller and we are the processor. What applies there is set out in the data processing agreement we conclude with your organisation.

What we process and why

When you use the contact form or e‑mail us. Your name, e‑mail address, the organisation you work for, your role, your telephone number if you give it, and what you write to us. The form sends that to us by e‑mail and also stores it in the website itself, so that a message is not lost if the send fails. We use it to answer your question and, where there is reason to, to stay in touch with you about the subject you wrote about. The legal basis is our legitimate interest in maintaining business contact, and where an agreement is running, the performance of that agreement. You are not obliged to give these details. If you would rather not use the form, e‑mail us directly at info@noctua.nl; then you decide what you send. To be able to reply we do need a name and an e‑mail address.

When you visit the website. The web server records which page was requested, when, from which IP address and with which browser. That is needed to deliver the site and to investigate faults and misuse. The legal basis is our legitimate interest in a working and secure website. We keep these log lines for thirty days.

Cookies

Before you consent, this website sets one cookie: pll_language, which remembers your language choice. We measure visitor numbers with Google Analytics, which only loads once you have given consent. You can withdraw that consent at the foot of any page; the cookie policy lists which cookies are set and how long they remain.

How long we keep it

Correspondence about a question or a request we keep for two years after the last contact. Where an agreement is running, we keep what belongs to it for as long as it runs and for seven years afterwards, because Dutch tax law requires that retention. Technical server logs we keep for thirty days, solely for administration and for investigating faults and misuse.

Who we give data to

We do not sell data and do not provide it to third parties for their own purposes. Parties that support us with hosting and email process data solely on our instructions, under a data processing agreement. Processing takes place within the European Economic Area.

Your rights

You can ask us which data we hold about you, have it corrected or erased, have the processing restricted, have your data transferred, and object to processing based on a legitimate interest. Send your request to info@noctua.nl or use the contact form. We respond within one month. To prevent us handing data to the wrong person, we may ask you to confirm your request from the e‑mail address it concerns.

If you disagree with how we handle your data, you can lodge a complaint with the Autoriteit Persoonsgegevens, the Dutch data protection authority.

No automated decision making

We do not take decisions about you based solely on automated processing, and we do not build profiles of visitors to this website.
